1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and FightMap ("FightMap," "we," "us," or "our"). By creating an account, signing in, or otherwise using the FightMap mobile apps or the website at fightmap.app (collectively, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
- You must be at least 13 years old to create an account.
- You must be at least 18 years old, or the age of majority in your jurisdiction, to buy tickets or accept payments through the Service.
- You agree to provide accurate information when you sign up and to keep it current.
- You are responsible for all activity that happens under your account and for keeping your password and devices secure. Notify us at security@fightmap.app immediately if you suspect unauthorized access.
- One person per account. Do not share login credentials.
3. What the Service does
FightMap is a marketplace that connects fans of combat sports with event promoters. Fans can discover events, view fight cards, and buy tickets. Promoters can list events and sell tickets through their own Stripe-connected account.
FightMap is not the organizer, host, or producer of any event listed on the Service. Events are produced and operated by independent promoters who are solely responsible for their events, including venue, scheduling, performers, safety, refunds, and customer service. FightMap is the platform that facilitates ticket sales between the promoter and the fan.
4. Buying tickets
- When you buy a ticket, you are entering into a transaction with the promoter, not with FightMap. FightMap acts as the promoter's limited agent for the purpose of collecting payment.
- Tickets are issued in your name and are non-transferable except as permitted by the promoter.
- Your ticket is delivered as a QR code in the FightMap app. Present it at the door for admission. A ticket may be scanned only once; counterfeit, copied, or transferred tickets may be denied entry.
- Tickets remain the property of the promoter and may be revoked for fraud, abuse, or violation of the venue's rules.
5. Refunds and cancellations
All ticket sales are final. Refunds and exchanges are at the discretion of the promoter, except in the following cases:
- Event cancellation. If a promoter cancels an event, you are entitled to a refund of the full amount you paid. We will process the refund to your original payment method within 14 days of cancellation.
- Event materially rescheduled. If a promoter substantially changes the date, time, or venue of an event, you may request a refund within 7 days of the change announcement by emailing support@fightmap.app.
- Duplicate charges or technical errors. If you were charged in error, contact support@fightmap.app within 30 days and we will investigate.
The FightMap platform fee is included in the ticket's listed price, so a refund of the ticket price refunds the fee as well. We do not offer refunds for change of mind, weather, traffic, missed transportation, or failure to comply with venue rules.
6. Promoter terms
If you create a promoter account and list an event, the following additional terms apply.
- Account verification. Promoters must complete Stripe Connect onboarding before listing events. You must provide accurate legal and tax information to Stripe.
- You are the merchant of record for tickets sold through your promoter account. You are responsible for the event itself, customer service, refunds (except those required by §5), tax collection and remittance, and compliance with all laws and regulations applicable to your event (including venue licensing, athletic commission rules, age restrictions, and accessibility requirements).
- Accuracy of listings. You must accurately describe your event, including date, time, venue, performers, fight card, ticket tiers, prices, and any restrictions. Misleading listings may be removed.
- Payouts. Payouts are issued by Stripe to your linked bank account on Stripe's standard schedule. FightMap does not hold your funds.
- Platform fee. FightMap retains ten percent (10%) of each ticket's listed price as a platform fee. The fee is deducted from the amount transferred to your Stripe-connected account — not charged separately to the customer. For example, on a ticket listed at $100, the customer pays $100; FightMap retains $10 and $90 (minus Stripe's processing fees) is transferred to your Stripe-connected account. Set your ticket prices accordingly.
- Cancellations. If you cancel an event after tickets have been sold, you must refund all ticket holders the full amount they paid. You may use Stripe's refund tools or coordinate manually.
- Removal. We may remove any event, suspend a promoter account, or hold a payout if we have a reasonable basis to believe the event is illegal, fraudulent, or violates these Terms.
7. Payments, fees, and taxes
- Ticket prices. The price displayed on each ticket is what you pay at checkout. No additional service fees are added on top. FightMap's 10% platform fee is included in that price and deducted from the promoter's payout (see §6).
- Currency. All prices are displayed and charged in U.S. dollars (USD) unless otherwise noted.
- Payment processing. Payments are processed by Stripe. By making a purchase, you agree to Stripe's end-user terms.
- Taxes. Promoters are responsible for the collection and remittance of any applicable sales, use, ticket, or amusement taxes. FightMap does not advise on or calculate taxes for promoters.
- Chargebacks. If you dispute a charge with your bank, please contact us first at support@fightmap.app. Fraudulent chargebacks may result in account suspension.
8. Acceptable use
You agree not to:
- Use the Service for any illegal purpose, or in violation of any local, state, federal, or international law.
- Buy, sell, or transfer tickets in violation of anti-scalping laws or promoter restrictions.
- Resell tickets purchased on FightMap on third-party marketplaces in violation of the promoter's stated resale policy.
- Use bots, scripts, or automated systems to access, scrape, or interact with the Service.
- Impersonate any person or entity or misrepresent your affiliation.
- Upload viruses, malware, or other harmful code; probe, scan, or test the vulnerability of any system; or interfere with the Service's operation.
- Harass, threaten, or abuse other users, promoters, or our staff.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by applicable law.
We may investigate and take legal action against violations, including suspension or termination of your account.
9. Your content
If you submit content to the Service (e.g., a promoter event description, banner image, or support message), you retain ownership of it. You grant FightMap a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as necessary to operate the Service.
You represent that you have all rights necessary to grant this license and that your content does not infringe any third party's rights or violate any law.
10. Our intellectual property
The Service, including the FightMap name, logo, app code, designs, and content (other than user-submitted content), is owned by FightMap and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
11. Third-party services
The Service includes or relies on third-party services, including Stripe (payments), Supabase (hosting), Google Maps (maps and location), and Apple / Google sign-in. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
FightMap does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy, completeness, or quality of any event listing, fight card, or other content submitted by promoters or third-party data sources.
Combat sports involve inherent physical risk to participants and, in some cases, to spectators. FightMap is not responsible for any injury, loss, or damage occurring at an event.
13. Limitation of liability
To the maximum extent permitted by law, FightMap and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.
Our total cumulative liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid to FightMap in service fees in the six months preceding the claim, or (b) one hundred U.S. dollars (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless FightMap and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any law or the rights of a third party, or (d) any content you submit to the Service.
15. Suspension and termination
You may stop using the Service at any time and may delete your account by emailing privacy@fightmap.app.
We may suspend or terminate your account at any time, with or without notice, if we have a reasonable basis to believe you have violated these Terms, abused the Service, or engaged in fraudulent, illegal, or harmful activity. Sections that by their nature should survive termination (including §§9-14, 16, and 18) will survive.
16. Disputes and governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and FightMap agree that any dispute, claim, or controversy arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, USA, and you consent to personal jurisdiction in those courts. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
Nothing in this section prevents you from bringing a claim before your local consumer protection authority, where applicable law gives you that right.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may delete your account.
18. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and FightMap regarding the Service and supersede any prior agreements.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failure or delay caused by events beyond reasonable control, including acts of God, war, terrorism, pandemic, government action, or internet outages.
- Apple App Store. If you obtained the iOS app through the App Store, you acknowledge that these Terms are between you and FightMap, not Apple. Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them.
- Google Play. If you obtained the Android app through Google Play, you acknowledge that these Terms are between you and FightMap, not Google. Google has no obligation to provide maintenance or support.
